GAME RULES

Your relationship as a user with us, Repeat Audio (with Chamber of Commerce number: 66099471 Gerrard Street BV), is subject to these Terms and Conditions, together with the references they contain, and are hereinafter referred to as: the Terms and Conditions. Please read this document carefully before ordering headphones via the website to ensure you understand the terms and conditions applicable at the time of your purchase.

We have the right to amend these General Terms and Conditions. You agree that the latest version of these Terms and Conditions will always apply to our agreement.

These Conditions are applicable from 1 Dec 2023. If you have a subscription with us, please check the additional subscription rules below in addition to this condition.

Subscription

Agreement between customer and Repeat Audio.

1.1 These Terms apply in full to all contracts, and other obligations between you and us, and exclude all other terms and conditions. Whether provided by you or third parties, unless Repeat Audio has previously agreed to them in writing.

1.2 These Terms and Conditions apply to the moment you make use of our subscription.

2.1 If you take the Free Repairs Forever service, this means that parts can be replaced free of charge when they are broken or worn out. You can take out this service per year or for life. 

2.2 As a current customer, you can switch to buy. You get a discount on the headphones you then want to buy. The discount is calculated based on the number of years you have been a customer. For this you need to contact info@repeat.audio.

2.3 The Free Repairs Forever service is only available for personal use, if you sell the headphones back to someone else, the service no longer applies.

2.4 Broken parts should be returned to Repeat Audio, reselling loose parts is therefore not allowed.

2.5 If we suspect abuse, we may terminate the service. It will then no longer be possible to order new parts via the website if something breaks.

3.1 The headphones we currently offer are delivered in the Netherlands, Belgium, France and Germany.

3.2 We will deliver the headphones to the address you provided when placing the order. You cannot change the address once we have dispatched the package.

3.3 The headphones are delivered in separate modules; namely two sound boxes, two buttons, two ear cushions, one headband, one cable and one jack connector, including instructions for assembling the modules.

3.4 In cases of force majeure, Repeat Audio cannot be held liable for any failure or delay in delivering our performance. In these conditions, "force majeure" means any cause beyond Repeat Audio's reasonable control that prevents normal fulfilment of an obligation.

4.1 You may return the headphones at any time within 30 days of receipt. You can do this by sending the headphones in the received packaging to Repeat Audio, Gouvernestraat 7C, 3014PH in Rotterdam

4.2 If we have received the product and it is undamaged, we will refund the full purchase price within 14 days.

4.3 You are responsible for the costs of the return shipment.

4.4 During the time you have to consider whether you want to keep the headphones, you must handle the product and its packaging with care.

4.5 Upon (premature) termination of the subscription, you must return the headphones in the box you received upon delivery, or in a box of your own. These should be sent to Repeat Audio, Gouvernestraat 7C, 3014PH in Rotterdam.

4.6 Upon (interim) termination of the subscription, the headphones will be returned to Repeat Audio within 30 days. If any parts are missing, these will be charged to you.

5.1 Repeat Audio aims to deliver the part to be replaced within 92 hours after the repair is specified via Repeat Audio's website.

5.2 The website contains instructions on how to test which module is defective.

5.3 If this target time is not met, you have no claim to any compensation or damages.

5.4 Upon delivery of the replacement module, a return envelope for the obsolete module will be provided. The return envelope including the obsolete module must be returned to Repeat Audio within 30 days. Repeat Audio will pay shipping costs in the event of repairs.

5.5 Repeat Audio reserves the right not to repair a headset, but to offer a replacement.

6.1 If you have purchased headphones from us with Free Repairs Forever, you will retain the Free Repairs Forever service in case of theft or loss.

6.2 In case of theft, you should always report it to the Police, and contact Repeat Audio. If no report is made, or the headphones are lost, and you want new headphones, we apply the following amount and depends on the model you have, see table 1.

6.3 If theft is reported, an Excess applies. The Excess for each type of model can be found in Table 2. Repeat Audio may request a copy of the report.

6.4 In the event of theft or loss of the headset, your Excess will be increased by €30.00

7.1 All amounts mentioned are inclusive of VAT.

7.2 The price for headphones is indicated in our webshop. You can pay in our webshop using iDeal. Repeat Audio reserves the right to change prices at any time. The prices listed at any time are the final prices. No rights can be derived from previously displayed prices.

7.3 If payment is not by direct debit, all Repeat Audio's invoices must be paid within 14 days of the invoice date to an account number specified by Repeat Audio. If no payment is made after 14 days, Repeat Audio will send a reminder which must be paid within 14 days. If the amount due is not paid within the period of 14 days, Repeat Audio may call in a collection agency. All additional administration and extrajudicial collection costs shall be borne by the subscriber.

8.1 The Free Repairs Service is entered into for an initial period as included in the subscription contract, annually or in perpetuity. After the expiry of the annual period, the agreement is continued on an annual basis. Repeat Audio has the right to terminate the subscription immediately if you:

  • does not comply with one or more provisions of the subscription, or does not do so on time or properly;
  • applies for a moratorium or is declared bankrupt;
  • dies;
  • you are or will be placed under guardianship or otherwise lose the free disposal of your assets;

 

8.2 You can cancel your Free Repairs service at any time. Please note that Repeat Audio will not refund any outstanding balance.

9.1 You are responsible for temporarily reporting any defects and damages.

9.2 We are not liable for damage caused by use of a product. This does not apply if such damage was caused by our wilful intent, gross negligence or deliberate recklessness. In any case, your right to compensation will be at most the amount of the product ordered and paid for.

10.1 You are obliged to provide correct, current and complete information (registration data) which is required to order our headphones. This information must be current at all times; you are therefore obliged to update this information in the event of changes. We cannot be held liable for damage caused by the fact that your registration details are not up-to-date.

10.2 We will use the registration data to deliver the headphones you ordered and to send you, before or after the sale, updates and information related to the headphones. We protect your personal data well; see also our Privacy Statement on our website. We will not sell that information to third parties and its processing is subject to existing privacy laws and regulations in the Netherlands.

10.3 If you are not of legal age, or if you are acting on behalf of someone else, you need permission from that person or a legal representative.

10.4 We reserve the right to dissolve the contract on reasonable grounds if information provided by you is incorrect, inaccurate, not current or incomplete. If the contract is cancelled on these grounds, you shall not be entitled to compensation and you shall be liable for damages suffered by Repeat Audio, such as additional shipping costs.

Repeat Audio reserves the right to amend these Terms and Conditions. Repeat Audio shall announce changes at least two weeks before they take effect.

14.1 If you have a complaint about the execution of the agreement, we would like to hear it. Please send your complaint as soon as possible (and describe it as fully as possible) to info@repeat.audio. We will deal with your complaint as quickly as possible, at the latest within four days after receipt of the complaint.

14.2 Both you and Repeat Audio have the right to terminate the subscription immediately if the other party has repeatedly and/or severely failed to fulfil its obligations as described in the Terms and Conditions.

13.1 Dutch law.

13.2 In the event of a dispute, the court in Central Netherlands shall have jurisdiction.

Article 1 - Order 

For your order, we need your name, e-mail address, address(es), payment details and sometimes your telephone number. We will register, store and process your data for the correct handling of your order. In addition, this data can be used for a possible later guarantee. We do not use any service providers for the processing of your order.

Article 2 - Newsletter 

Repeat Audio offers newsletters. This keeps you informed of offers, (discount) promotions and other news. To ensure your permission, we use the opt-in system for newsletters. An unsubscribe option is included with every communication along these lines.

Article 3 - Market research 

We may ask you to participate in a market survey. Repeat Audio will then use your data for the market research. We use this statistical data anonymously for Repeat Audio. You can close the questionnaire at any time. We do not give your answers to third parties and they never become public. In addition, the answers will not be linked to your e-mail address.

Article 4 - Examination and amendment of your data 

If you have any questions about our privacy policy, please contact us. You can review, change or delete your personal data.

Article 5 - Amendments to this Privacy Statement 

Repeat Audio may amend this privacy statement. We will notify users who are registered with us with their e-mail address of any changes. If you are not registered as a user, we advise you to consult this statement regularly. additional GAME subscription

These Terms are effective from 1 July 2019. 

1.1 The headphones are rented for a minimum of one period (depending on whether you have or have purchased a subscription) and the subscription has an unlimited duration. The notice period is one month. Cancellation must be done via 'My Account' on the Repeat Audio website before the start of the subsequent period.

1.2 The following items are included in the subscription:

Hire of headphones;

Repair service due to wear and tear and use, for example;

  • Ear and head cushion(s)
  • Sounding boards
  • Cable(s)
  • Buttons
  • Headband

Upgrades;

Shipments of repairs (return envelopes and shipping costs will be paid by Repeat Audio).

1.3 Repeat Audio reserves the right to terminate the subscription immediately.

1.4 The headphones remain the property of Repeat Audio.

1.5 Reselling or renting out the headphones is prohibited.

2.1 The subscriber is obliged to pay the subscription fee.

2.2 The subscriber is obliged to check that the headset is complete upon receipt, and to report any incompleteness within 7 days.

2.3 You do not make any changes to the headphones unless this is necessary for a repair and at Repeat Audio's instruction.

2.4 If you give the headset in use to a third party, that third party will also be bound by these Terms and Conditions. In doing so, the subscriber remains ultimately responsible for the obligations under this agreement.

3.1 When entering into a subscription, you authorise Repeat Audio to debit monthly subscription fees, and any other expenses incurred, automatically from the specified account number with collector ID NL78ZZZ660994710000.

3.2 Repeat Audio is not liable for payment arrears due to cancellations or refusal of bank of subscription holder. You can see which payments are outstanding in your account; these must be transferred to Repeat Audio in the appropriate manner, stating your subscription ID.

4.1 You may return the headphones at any time within 30 days of receipt. You can do this by sending the headphones in the received packaging to Repeat Audio, Gouvernestraat 7C, 3014PH in Rotterdam

4.2 If we have received the product and it is undamaged, we will refund the full purchase price within 14 days.

4.3 You are responsible for the costs of the return shipment.

4.4 During the time you have to consider whether you want to keep the headphones, you must handle the product and its packaging with care.

4.5 Upon (premature) termination of the subscription, you must return the headphones in the box you received upon delivery, or in a box of your own. These should be sent to Repeat Audio, Gouvernestraat 7C, 3014PH in Rotterdam.

4.6 Upon (interim) termination of the subscription, the headphones will be returned to Repeat Audio within 30 days. If any parts are missing, these will be charged to you.

If the headphones are not returned to Repeat Audio within the 30-day period after termination of the contract or after a subscription switch, Repeat Audio reserves the right to charge a penalty. This fine depends on your subscription type see table 3. Repeat Audio may also file a report against you, for theft of the headphones.

The headphones must be returned complete. If this is not the case, Repeat Audio has the right to charge the customer for the missing part. Table 4 shows the prices for the parts that will be charged if they are not returned.

6.1 The subscription is entered into for an initial period as included in the subscription contract. After expiry of the period, the agreement is continued for an indefinite period. Repeat Audio has the right to terminate the subscription immediately if you:

  • does not comply with one or more provisions of the subscription, or does not do so on time or properly;
  • applies for a moratorium or is declared bankrupt;
  • dies;
  • you are or will be placed under guardianship or otherwise lose the free disposal of your assets;

6.2 You can cancel your subscription at any time by returning the headphones via the return form. Please note that Repeat Audio will not refund any outstanding credit. So suppose you return your headphones with annual subscription after 3 months, that might be a waste.
